"Private Faith, Public Square"

- Dr. Patricia McIntyre, Saint Mary-of-the-Woods College

The First Amendment clauses that demand church/state separation and guarantee free exercise of religion raise conflicting claims to rights. Sincerely held beliefs of faithful people bind them to codes of ethics that clash with public law and, sometimes, laws actually demand that believers violate their ethical requirements. At that point, judicial review is the process on which this society relies to negotiate some resolution. This is correct because judicial review offers the greatest good, even when it does not produce the greatest satisfaction.
