Plea Indication Statement

When formal charges have been brought against a student, each individual student has the right to accept or not accept responsibility for the alleged violations

The Plea Indication Statement is a student's notification to the Office of Student Conduct and Integrity regarding the direction the student would like to pursue in order to resolve the alleged violations.

All students' facing formal charges from the Office of Student Conduct and Integrity are provided an opportunity to choose from several options.  These options include: not accepting any responsibility, accepting responsibility for some but not all of the alleged violations, accepting responsibility for all alleged violation however offering further (mitigating) information, or accepting full responsibility  and waiving their right to a hearing.

Plea Options

Option 1:

"I am not responsible for any act in violation of the regulations specified in the charges."

If a student does not believe that they have any responsibility to the violations or situation in question then they may choose to mark this option. 

A student considering this option should interpret it as he/she having no responsibility or no part in the alleged violation(s).

Option 2:

“I accept responsibility for acts which violate some of the regulations specified in the charges.  However, I request a hearing with the All-University Court in order to show that I am not responsible for the following violations.”

When a student is charged with multiple violations he or she may choose to accept responsibility for some (but not all) of the alleged violations. 

Option 3:

“I accept responsibility for acts which violate the regulations specified in the charges and offer mitigating information.”

The student agrees he or she are responsible for all alleged acts (or acts of their guests and associates) which violate the Code of Student Conduct.

Mitigating information is information a student believes would positively affect the outcome of the meeting or is additional information they wish the hearing body to consider.

 

Option 4:

“I accept responsibility for acts that violate the regulations specified in the charges and waive my right to a hearing.  I understand that this choice allows the Director of Student Judicial Programs to make a finding based solely on the content of the complaint and supporting documentation.”

This is an option for a student who agrees he or she are responsible for all violations and does not wish to offer any other information.

When considering this option, the student agrees all the information is presented and accurate as well as if they fully understand they are responsible for what occurred.

 

Choosing a hearing type

The accused student may choose in which format he/she would prefer the pending case be heard.  The student may choose a hearing with the All-University Court or Administrative Hearing.

 

Returning a Plea Indication Form

All Plea Indication Statement Forms are to be returned to the Office of Student Conduct and Integrity within two business days after the student has received the information.  The Office of Student Conduct and Integrity is located on the 8th Floor of the Hulman Memorial Student Union Building. (campus map building #27) The plea may also be faxed to 812-237-9679.

 

After a Plea is Returned

After a Plea Indication Statement is returned, a the Office of Student Conduct and Integrity staff member will meet with the accused student to ensure an understanding of the options.  After review, a hearing will be scheduled dependent upon the class schedule of the student and the administrator/justices hearing the case.  The Office of Student Conduct and Integrity will send a notice to the student with the date and time of the hearing.
